TERMS AND CONDITIONS FOR PLAYDAYZ PLAYDATES SUBSCRIPTION

These Terms and Conditions (“Terms”) govern your access to and use of the PlayDayz Playdates mobile application (the “App”), operated by PlayDayz Playdates Limited (“PlayDayz”, “we”, “us”, or “our”).
By subscribing to, accessing, or using the App, you confirm that you have read, understood, and agree to be legally bound by these Terms. If you do not agree, you must not use the App.
1. The Service
1.1 PlayDayz is a digital platform that enables parents and guardians to connect with local families, organise playdates, and coordinate informal, community-based childcare arrangements.
1.2 PlayDayz acts solely as a neutral technology platform facilitating communication, discovery, and scheduling between users. We do not provide childcare services, supervision, vetting, or guarantees regarding the safety, suitability, or outcomes of any user arrangements.
1.3 All interactions, arrangements, and agreements are made solely between users. Users are fully responsible for their own decisions, communications, and participation in any activities arranged through the App.
2. Subscription Plan
2.1 The App operates on a membership model that provides full access to core PlayDayz features, including:
- Creation and participation in parent-and-child playdates
- Discovery and connection with local families
- Private community-based childcare coordination within trusted networks
2.2 Membership is available on either a monthly or annual subscription basis, selected at the point of purchase.
2.3 Subscriptions renew automatically at the end of each billing period (monthly or annually), unless cancelled prior to the renewal date.
2.4 You may cancel your subscription at any time via your account settings. Cancellation will prevent future billing but will not result in refunds for any fees already paid, except where required by applicable law.
3. Eligibility
3.1 You must be at least 18 years old to register and use the App.
3.2 The App is intended for personal, non-commercial use only.
3.3 You confirm that all information provided is accurate, complete, and kept up to date.
4. Payments and Billing
4.1 Subscription fees are charged in advance based on the selected billing cycle (monthly or annual).
4.2 You authorise recurring payments for the duration of your subscription.
4.3 Fees are non-refundable except where required by applicable law.
4.4 Failure to process payment may result in suspension or termination of access.
5. Community Standards and Conduct
5.1 Users must behave respectfully, responsibly, and in good faith at all times.
5.2 PlayDayz does not mediate disputes between users. All disagreements must be resolved directly between users.
5.3 Commercial activity, solicitation, or exchange of payment between users is strictly prohibited.
5.4 Harassment, discrimination, abuse, or inappropriate behaviour will result in suspension or termination of access.
6. User Responsibilities
6.1 Users are responsible for maintaining the confidentiality of their account.
6.2 Account access must not be shared outside of your household.
6.3 Users are responsible for all activity conducted under their account.
6.4 Any personal contact information exchanged between users is shared voluntarily. PlayDayz does not disclose user contact details.
7. Data Protection
7.1 Personal data is processed in accordance with the PlayDayz Privacy Policy, which forms part of these Terms.
7.2 PlayDayz does not sell personal data.
7.3 User contact details remain private unless voluntarily shared by users within the App.
8. Platform Role and Liability Disclaimer
8.1 PlayDayz is a neutral intermediary platform and does not supervise, endorse, or control user interactions or arrangements.
8.2 Users acknowledge and accept that participation in any activity arranged through the App is at their own risk.
8.3 To the fullest extent permitted by law, PlayDayz shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from use of the App.
8.4 The App is provided on an “as is” and “as available” basis without warranties of any kind.
8.5 Users agree to indemnify and hold harmless PlayDayz against any claims, liabilities, losses, damages, or expenses arising from their use of the App or breach of these Terms.
9. Cancellation and Termination
9.1 Users may cancel their subscription at any time via account settings.
9.2 Cancellation prevents future billing but does not entitle users to refunds for unused time.
9.3 We reserve the right to suspend or terminate access where users breach these Terms or Community Guidelines.
10. Changes to Terms
10.1 We may update or modify these Terms from time to time.
10.2 Where reasonably practicable, material changes will be communicated in advance.
10.3 Continued use of the App constitutes acceptance of updated Terms.
11. Intellectual Property
11.1 All intellectual property rights in the App, including branding, software, design, and content, are owned by PlayDayz Playdates Limited.
11.2 Users are granted a limited, non-exclusive, non-transferable licence to use the App for its intended purpose.
11.3 Users may not copy, modify, distribute, reverse engineer, or commercially exploit any part of the App without prior written consent.
12. Governing Law
12.1 These Terms are governed by the laws of Ireland.
12.2 Users in the EU/EEA or UK may also benefit from mandatory consumer protection laws in their country of residence.
12.3 Any disputes shall be subject to the exclusive jurisdiction of the Irish courts, subject to mandatory local consumer rights.
